  • Family law trials, mediations, and litigation involving both uncontested and highly contested disputes regarding divorce, child support, parenting time (“custody”), spousal support, division of assets, valuation of businesses, relocation, marital waste claims, intentional under/unemployment and modifications.
  • Trial involving a claim for a $6 million brokerage commission and breach of contract for the rental of office space at the World Trade Center. A settlement was reached on the first day of trial.
  • Trial Team for a 10-week trial involving claims of fraud, breach of contract, and misrepresentation involving paging technology. The client was sued for $750 million dollars. The jury deliberated for only 2 hours and found a full defense verdict in favor of our client.
  • National Coordinating Counsel for class actions against two clients, in fifteen states, involving allegedly defective DVD players. Lynda was personally responsible for the coordination of counsel, schedules, motions and strategy in fifteen different states, as well as involvement in negotiations with lead plaintiff’s counsel. The cases settled.
  • Deposed witnesses, weekly client contact, coordination of discovery involving 3000 boxes of documents, strategic planning, assisted in negotiation and drafting of settlement worth approximately $3 billion in class actions involving allegedly defective tire repair technique. The case settled after approximately one year of litigation.
  • Successful defense and counterclaim with unanimous jury verdict on all counts for defendant involving claims of misappropriation of trade secrets, breach of contract, defamation and claim for attorney’s fees and costs.
  • Successful defense against appeal to Court of Appeals and Arizona Supreme Court to overturn client’s jury verdict.
  • Litigation and settlement of claim against national food manufacturer and distributor for fraudulent failure to pay independent contractor consistent with the parties’ contract.
  • Litigation on behalf of restaurant’s new owner stemming from conduct by former owner towards employees.
  • Achieved ruling permitting parent to relocate with the parties’ minor children.
  • Achieved favorable ruling on parenting time (custody), legal decision making authority, division of assets and debts, contempt and attorney’s fee award in high-conflict case including 14 hearings in __ month period.
  • Achieved contempt rulings and enforcement of Court Orders concerning failure to pay Child Support, failure to pay Spousal Support, failure to return personal property, and other failures to comply with Court Orders.
  • Numerous jury trials, bench trials, and arbitrations involving civil and commercial litigation, parental rights, and felonies. Published – “Manufacturer-to-Patient Advertising: Further Advice Following Perez,” Product Liability Law & Strategy, January 2000, co-authored with Arvin Maskin and Konrad Cailteaux
  • Achieved ruling finding fraud and misappropriation of significant funds belonging to community’s business and Order requiring repayment of defrauded spouse’s portion of those funds.
  • Successful claim on behalf of senior citizen victim of marketing scam
  • Successful claim on behalf of senior citizen victim of individual con-man who stole hundreds of thousands of dollars for fraudulent business promises
  • Litigation and settlement on behalf of sisters against older sibling who committed financial exploitation against the parties’ vulnerable parent
  • Defeated Child Protective Services’ trial seeking guardianship and achieved Return to Parent after multi-year long litigation on behalf of Mother of a special needs child.
  • Numerous jury trials, bench trials, and arbitrations involving civil and commercial litigation, parental rights, and felonies.
  • Lynda Vescio has taught Continuing Legal Education Classes on Legal Research Skills and Strategies and on Effective Cross-Examination Techniques.
